Due to the CCU’s decision, the NACP has to suspend the inspections of prevention of corruption in five Ukrainian state institutions
According to the decision of the Constitutional Court of Ukraine No. 13-r/2020 of October 27, 2020, the National Agency on Corruption Prevention (NACP) is deprived of the right to conduct inspections of prevention and detection of corruption. Thus, the NACP terminated scheduled inspections at: The State Agency for Motor Roads of Ukraine (Ukravtodor); The National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes (Asset Recovery and Management Agency, ARMA); The Secretariat of the Commissioner for Human Rights of the Verkhovna...
Regarding the letter from the Presidents of the Venice Commission and GRECO to the Chairman of the Verkhovna Rada on the constitutional crisis in Ukraine
Yesterday, October 31, the Council of Europe published an official letter from the President of the Group of States against Corruption (GRECO) Marin Mrčela and the President of the Venice Commission Gianni Buquicchio to the Speaker of the Verkhovna Rada of Ukraine Dmytro Razumkov regarding the last ruling of the Constitutional Court of Ukraine (CCU). When deciding on the rapid recovery of the anti-corruption system, all the stakeholders should consider that it is not possible to provide it if the CCU’s ruling remains unchanged. Thus, in this situation it is necessary to consider the fo...
The NACP Head explained why the CCU adopted the decision in the “case on illicit enrichment’ so promptly
The Constitutional Court of Ukraine (CCU) in record time considered the petition of 47 MPs in the “case on illicit enrichment” to protect their own interests. This was announced by the Head of the National Agency on Corruption Prevention (NACP) Oleksandr Novikov during an appearance on the “Freedom of Speech by Savik Shuster”. “On October 1, 2020, 30 days ago, the Chairman of the CCU Oleksandr Tupytskyi received a request from the NACP to provide an explanation on a power of attorney filed in the Register of Ukraine for land transactions in Crimea. On October 7, the Chairman of the Cons...
The NACP checked the declarations of 2 of the 47 MPs that submitted the constitutional petition in the “case on illicit enrichment”
Recently, we have often seen the question about the MPs that submitted a constitutional petition in the “case on illicit enrichment” to the Constitutional Court of Ukraine. The National Agency on Corruption Prevention noted that the full check of declarations of these two MPs – Ilia Kyva and Taras Kozak – was initiated earlier. We consider it necessary to publish the list of the rest of MPs, noting that some of them are involved in journalistic investigations, as well as cases of the National Anti-Corruption Bureau of Ukraine. Thus, the signatories to the constitutional petition in th...
Through the decision of the President and the Government, the NACP restored access to the Register of Declarations
At an extraordinary meeting initiated by the President, the Cabinet of Ministers of Ukraine adopted an Order obliging the National Agency on Corruption Prevention to ensure open round-the-clock access to the public section of the Unified State Register of Declarations. Pursuant to the Order, the NACP restored public access to the Register at public.nazk.gov.ua. The adopted decision will also enable the National Agency to conduct special inspections and unblock the appointment of heads of state bodies and local governments. “This is the first step towards restoring an effective anti-co...
Restoring public access to the Register of Declarations: what was decided during the urgent meeting of the National Security and Defense Council convened by the President
Today, President Volodymyr Zelensky urgently convened a meeting of the National Security and Defense Council to review the decision of the Constitutional Court of Ukraine, which was attended by the Head of the National Agency on Corruption Prevention Oleksandr Novikov. The President categorically disagreed with the abolition of electronic declaring. He also noted that the dismantling of NACP’s control functions and criminal liability for knowingly violating the law when submitting the declarations will never be perceived by either Ukrainian society or European partners. Thus, during the ...
The CCU blocked the appointment of government officials, including the winners of local elections
The Constitutional Court of Ukraine denied the National Agency on Corruption Prevention (NACP) the access to State Registers required for conducting a special check of declarations of candidates for leadership positions in the state bodies. Without this check, no head of state body can be officially appointed. The CCU basically blocked the implementation of local election results. As the appointment of candidates elected to positions, in particular the heads of Oblast and Rayon Councils and their Deputies, is possible only after they undergo special checks. “By its decision, the Const...
The NACP closes access to the Register of declarations to implement CCU’s decision
Pursuant to the decision of the Constitutional Court of Ukraine No. 13-r/2020 of October 27, 2020, the National Agency on Corruption Prevention (NACP) today, on October 28, at 19:00, closes access to the Unified State Register of Declarations. This means that the state bodies and the public no longer have open round-the-clock access to electronic declarations of officials, and the NACP stops their checking, filing and publishing. “This is a crushing defeat of anti-corruption reform in Ukraine. We hope that legislators will not ignore this situation, and there is still a chance for Ukraine to...
Corrupt practices in Ukraine win at the highest level: judges of the Constitutional Court ruled in the “case on illicit enrichment” in their own interests
The National Agency on Corruption Prevention (NACP) found indications of inaccurate information in the declarations of two judges of the Constitutional Court – Iryna Zavhorodna and Serhiy Holovaty. This is a violation of Article 366-1 of the Criminal Code of Ukraine. Today, the judges voted to declare this Article unconstitutional. This indicates that Iryna Zavhorodna and Serhiy Holovaty have a conflict of interest when participating in the adoption of decisions. The Law prohibits the judges to participate in a case under such conditions. Thus, the declaration of Serhiy Holovaty f...
The “closedness” of the meeting calls into question the constitutionality and objectivity of the CCU’s decision in the case on liability for illicit enrichment — NACP Head
Today, on October 20, the Constitutional Court of Ukraine (CCU) continued the consideration of the case in which, inter alia, it proposed to declare liability for illicit enrichment, round-the-clock access to the Register of declarations and seizure of the unlawfully acquired assets unconstitutional. The National Agency on Corruption Prevention (NACP) is one of the participants in this case. The hearing took place in writing: the Court did not hear the participants in the case, but read their written explanations behind closed doors. “The closed consideration is a direct violation of ...
