Persons referred to in Article 3, Part 1, par. 1 of the Law may not have persons close to them as direct subordinates or be directly subordinate to persons close to them in connection with exercise of powers.
Persons applying for positions specified in Article 3, Part 1, par. 1 of the Law are obliged to inform the management of the body, for the position they are applying for, of any persons close to them who work in such a body.
These provisions do not apply to:
- lay judges and jurors;
- close persons that are directly subordinate to each other in connection with the obtaining by one of them the status of an elected person;
- persons working in rural settlements (except for rayon centers), as well as mountain settlements.
In case the circumstances which violate the above requirements arise, the relevant persons, the persons close to them shall take measures to eliminate such circumstances within fifteen days.
If within the specified timeframe these circumstances are not voluntarily eliminated, the relevant person or persons close to them are subject to transfer under the established procedure to another position that avoids direct subordination within a month from the moment of occurrence of circumstances.
If such a transfer is not possible, the subordinate persons shall be subject to dismissal.
