Main functions of the
Directorate for Developing Legal Positions on Declaration and Conflict of Interest Issues:
1) provides clarifications, methodological and consultative assistance (including through the official communication channels – hotlines, email, etc. – and social media of the National Agency) regarding the application of the provisions of the Law of Ukraine “On Preventing Corruption” (hereinafter – the Law) and the regulatory legal acts adopted for its implementation on issues of financial control, ethical conduct, prevention and settlement of conflicts of interest in the activities of persons authorized to perform state or local government functions, and persons equated to them, as well as restrictions on receiving gifts, joint work of close persons, on part-time work and combining it with other types of activities, restrictions after termination of activities related to the performance of state, local government functions, in the activities of persons authorized to perform state or local government functions, and persons equated to them;
2) develops concepts and proposals for improving legislation aimed at increasing the effectiveness of anti-corruption mechanisms and processes, within the competence of the Directorate;
3) conducts analysis of regulatory legal acts, draft regulatory legal acts that may affect the state anti-corruption policy in the field of financial control, prevention and settlement of conflicts of interest, requirements and restrictions stipulated by the Law, prepares a conclusion (position) regarding such regulatory legal acts, draft regulatory legal acts;
4) develops tools aimed at simplifying the process of declaration, prevention and settlement of conflicts of interest;
5) participates in the informational content creation for the official website of the National Agency, in particular the "Knowledge Base" section;
6) provides information upon a corresponding request regarding general issues of the National Agency's activity through official communication channels (hotlines, email, etc.) and social media of the National Agency;
7) provides informational and technical support during work with state registers, the maintenance of which is ensured by the National Agency;
8) receives reports of possible facts of corruption or corruption-related offenses, other violations of the Law through a dedicated hotline;
9) carries out a preliminary review of reports (including anonymous ones) of possible facts of corruption or corruption-related offenses, other violations of the Law;
10) transfers materials to other independent structural divisions of the National Agency's staff for detailed analysis and resolution of the issue of the necessity to take measures in accordance with the competence regarding persons covered by the Law, in case of detecting possible violations of the Law's requirements by them;
11) organizes the provision, in accordance with the Law of Ukraine “On Access to Public Information,” of access to public information held by the National Agency, in terms of providing timely, accurate, and complete information in response to requests for information received by the National Agency; organizes the review, monitoring, and control of requests for public information;
12) organizes the provision, in accordance with the Law of Ukraine “On Citizens' Appeals,” of qualified, objective, and timely consideration of citizens' applications, proposals, and complaints received by the National Agency; conducts analysis of citizens' appeals received by the National Agency.
