
The appellate instance confirmed the conclusion of the Druzhkiv city court, by which the judge of the Dobropil city district court of Donetsk region was found guilty of committing an administrative offense related to corruption - acting in conditions of a real conflict of interests, which was stated in the protocol of the NAСP.
Disagreeing with the decision of the court of first instance, the judge of the Dobropil City District Court filed an appeal to the Dnipro Court of Appeal, in which she asked to close the proceedings in the case due to the lack of composition and the event of the offense. However, the appellate review confirmed that the judge is guilty and must pay a fine of UAH 3,400.
According to the provisions of the Law "On the Judiciary and the Status of Judges", such actions can be recognized as a significant disciplinary offense or gross neglect of the duties of a judge, which is incompatible with this status. And therefore, a judge of the Dobropil city and district court may also be subject to a separate type of disciplinary liability - a motion to dismiss a judge from office based on her conviction for committing an offense related to corruption.
In this regard, the NACP will turn to the High Council of Justice, which is empowered to conduct disciplinary proceedings against judges.
