Conflict of interest: a protocol against a judge, substantiated conclusions regarding Kyiv City State Administration officials and disciplinary actions in August

Last month, the National Agency on Corruption Prevention (‘NACP’) drew up a series of protocols and substantiated conclusions aimed at identifying and responding to corruption and corruption-related offences and ensured that those responsible were brought to justice.

Protocols on administrative offences were drawn up

NACP drew up and sent to court a protocol under Article 172-5 of the Code of Administrative Offences (violation of restrictions on receiving gifts) concerning a former judge of the Poltava District Court of Poltava Region. During 2023-2025, the official used a vehicle under the terms of a contract with a person who was not a relative, paying UAH 10,000 per month. This price was significantly lower than the minimum market price. The total value of the gift was UAH 99,500, which is a violation of the law.

Court decisions

The Court of Appeal upheld the decision of the court of first instance, which found the director of the Kyiv City Council Department guilty of committing an offence under Part 1 of Article 188-46 of the Code of Administrative Offences (failure to provide information at the request of the NACP).

Reasoned conclusions sent

Based on NACP materials, a protocol was drawn up regarding an official of the Audit Department of the Kyiv City State Administration who, in 2019-2025, simultaneously held the position of director in a private company, which contradicts paragraph 2 of Part 1 of Article 25 of the Law of Ukraine ‘On Prevention of Corruption’. The materials were transferred to the Shevchenkivskyi District Court of Kyiv.

The court found another official of the Department of Cultural Heritage Protection of the Kyiv City State Administration guilty of committing an administrative offence under Part 2 of Article 172-4 of the Code of Administrative Offences and imposed a fine.

Compliance with NACP orders

In compliance with NACP orders, state bodies and institutions conducted official investigations, eliminated the identified violations, and brought the guilty parties to disciplinary responsibility. In particular, this concerns:

  • the State Regulatory Service of Ukraine;
  • the Department of Cultural Heritage Protection of the Kyiv City State Administration;
  • the Artek International Children's Centre;
  • the M.I. Pirogov Vinnytsia National Medical University;
  • the Garant-Service State Enterprise of the State Administration of Affairs for the Service of Official Events;
  • the Expocentre of Ukraine National Complex.

NACP continues its systematic work to prevent and combat corruption, as well as to monitor compliance with anti-corruption legislation.
