Access of NACP to the Europol platform, external audit of the NABU, implementation of the Asset Recovery Strategy: key results of the implementation of the SAP in the 3rd quarter

The National Agency on Corruption Prevention (NACP) conducted the sixth quarterly monitoring of the implementation of the State Anti-Corruption Program for 2023-2025.

In the third quarter, government agencies implemented 402 measures in full or in part, which is 34% of their total number (1187 measures); 234 measures are in progress (19.7%); 295 measures have not been started (24.9%); 256 measures remain unimplemented (21.6%).

The main results of the implementation of the SAPO measures are aimed at strengthening the institutional capacity of the anti-corruption agencies, facilitating the process of European integration and implementation of the best international practices.

Key activities include NACP access to the Europol SIENA portal, approval of the action plan for the implementation of the Asset Recovery Strategy and the composition of the Commission for External Independent Assessment (Audit) of the NABU's performance.

Asset Recovery Strategy for 2024-2025

On August 13, 2024, the Government approved an action plan for the implementation of the Asset Recovery Strategy for 2024-2025. The document was developed by the National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes (ARMA).

The plan outlines a roadmap of measures that will strengthen the tracing and management of seized assets in Ukraine and bring it closer to the best international standards. In particular, it is planned to expand ARMA's cooperation with law enforcement and other government agencies, banking institutions, civil society, the private sector and international partners.

The development of the strategy is also envisaged by the commitments under the International Monetary Fund Program and the Ukraine Facility Plan, which is the basis for the provision of assistance from the European Union (EU).

This is a measure of the SAP 3.3.3.9.3, with ARMA as the main executor.

Access of the NACP to the SIENA platform

In September 2024, the NACP gained access to the Europol SIENA platform. This allows for the exchange of information with law enforcement agencies of EU member states and increases the effectiveness of preventing and combating corruption.

Access to SIENA's international databases and tools will allow the NACP to quickly track financial flows and identify suspicious assets, which will help in uncovering complex corruption schemes both inside and outside the country.

The use of SIENA will facilitate fast and meaningful exchange of information with foreign partners, as the platform has become a channel for information exchange for specialized law enforcement units, asset recovery offices, financial intelligence units, etc.

External audit of the NABU

The Government has approved the composition of the Commission of International Experts who will conduct an external independent assessment (audit) of the NABU's performance.

The Ministry of Foreign Affairs of Ukraine (MFA) organized the process of preparing proposals for the Commission.

The Independent Commission was formed to provide suggestions and recommendations to improve the NABU's performance in line with international best practices, as well as to determine the way forward for the agency to fully realize its potential. The external audit is also an important criterion in the context of Ukraine's receipt of international financial assistance under the IMF's revised Extended Fund Facility program and its membership in the European Union.

The external audit of the NABU began on October 3, 2024 and will last until the end of February 2025.

The measure of the Action Plan is 2.1.7.3.2, the main executor is the MFA.
