The Holosiivskyi District Court of Kyiv has found acting Chairman of the Constitutional Court of Ukraine (CCU) Serhiy Holovaty guilty of committing an administrative offense and ordered him to pay a fine. The court ruling may be appealed within ten days from the date of its issuance. After the court decision enters into force, information about the judge will be entered into the Unified State Register of Persons Who Committed Corruption and Corruption-Related Offenses.
The court found that the acting Head of the CCU did not comply with the legal requirements of the National Agency for the Prevention of Corruption (NACP), namely, he did not eliminate the violation of the requirements of Article 12, Part 8 of the Law of Ukraine "On Prevention of Corruption" and did not provide the information and copies of documents requested in the NACP's request of 09/14/2023. By doing so, he violated the requirements of clauses 1-1, part 1, para. 2 of Part 6, and Part 8 of Article 12 of the Law of Ukraine "On Prevention of Corruption".
In November 2023, the NACP drew up reports on an administrative offense against acting Head of the CCU, Serhii Holovatyi.
It should be reminded that the State Anti-Corruption Program for 2023-2025 (SACP), developed by the NACP and approved by the Government, allows for comprehensively addressing existing problems in the judicial system that have been causing great damage to its authority and shaping the attitude of citizens for years. The document creates safeguards against existing corruption risks and provides for preventive anti-corruption measures.
The Specialized Anti-Corruption Program (SACP) envisages independent assessment of the integrity of HCJ and HQCJ members, clear criteria of integrity and professional ethics for qualification assessment of judges, prompt, open, and fair consideration of disciplinary cases against judges in real time, and the introduction of criminal liability for judges for arbitrary abuse of power.
