Conflict of interest: June protocols, orders and court decisions

In June 2024, National Agency on Corruption Prevention (NACP) drew up a number of protocols on administrative violations and issued an order for violation of the law on ethical behavior, prevention and settlement of conflicts of interest. One court decision was also made based on the National Agency materials.

Thus, the Kovpakivskyi District Court of Sumy found the Acting Deputy Head of the Investigation Department of the Sumy District Police Department of the National Police in Sumy Region guilty of committing an administrative offense related to corruption under Part 1 of Art. 172-9 of the Code of Administrative Offenses and imposed a fine on him. 

The case was considered based on NACP protocol drawn up in the course of an inspection of the organization of work on preventing and detecting corruption by the National Police of Ukraine. The court found that the officer, after receiving NACP substantiated conclusion, failed to ensure that information was entered into the Unified Register of Pre-trial Investigations regarding officials of a regional charitable foundation.  In this way, the police officer concealed the commission of a possible corruption offense detected by the National Agency.

In June,  NACP drew up a report for committing administrative offenses under Part 1 of Art. 172-5 of the Code of Administrative Offenses against the Deputy Head of the Main Department of the State Tax Service in Kirovohrad Oblast. It was established that during 2018-2022, she received gifts from an individual who is not her close relative in the form of free use of a MERCEDES-BENZ GLE 250 car, which violated the restrictions established by the Law on Prevention of Corruption.

A similar report was drawn up against the Head of the Department for Prevention of Financial Transactions Related to Legalization of Proceeds of Crime of the Main Department of the State Tax Service in Odesa Region.It was established that from 2018 to the present, the official received gifts from an individual who is not her close relative in the form of free use of an AUDI A6 car, which also violated the restrictions established by law.

The order for violation of Article 56 of the Law was issued to the acting Head of the State Agency of Ukraine for the Development of Land Reclamation, Fisheries and Food Programs. He failed to ensure that a special inspection of his subordinate, the Head of the Department of the State Agency for the Development of Land Reclamation, Fisheries and Food Programs in Kherson Oblast, was conducted.

NACP goal is to reduce the number of corruption offenses. Therefore, first of all, the National Agency seeks to raise awareness of officials and all citizens in the issues of preventing and resolving conflicts of interest.

For this purpose, we have developed tests that will help you become more experienced in integrity issues:

a test to determine whether or not there is a conflict of interest - this test will help those public servants who have doubts to quickly understand many typical problem situations;

a test for resolving conflicts of interest - this test will tell you whom to notify and what steps to take to resolve them if a conflict of interest arises;

a test for a manager to choose a way to resolve a conflict of interest in his/her subordinates - this test will help the manager to determine the best actions to resolve a conflict of interest in a subordinate.
