Civil forfeiture: HACC Appeals Chamber upheld the recovery of UAH 8.5 million from a couple of customs officials and their son - a district council official

On January 27, 2026, the Appeals Chamber of the High Anti-Corruption Court (HACC Appeals Chamber) upheld the decision of the first-instance court, which recognized assets belonging to a couple of customs officials — a department head and a chief state inspector of the Odesa Customs — as well as their son, an official of a district council in the Kyiv region, as unsubstantiated and recovered them as state revenue (civil forfeiture).

The basis for the HACC Appeals Chamber's decision was the results of lifestyle monitoring conducted by the National Agency on Corruption Prevention (NACP).

During the monitoring, NACP authorised officials established that in 2021, the couple acquired ownership of an apartment in Odesa with an area of 103.8 sq. m. Their son, who holds the position of deputy chairman of a district council in the Kyiv region, purchased an apartment in the capital with an area of 105.5 sq. m and a 2018 TOYOTA RAV-4 HYBRID vehicle. At the same time, the officials registered the ownership of these assets in the name of a close relative born in 1937. The amount of illegal assets reaches UAH 8.5 million.

It is also worth noting that after the start of the lifestyle monitoring of the mentioned subjects, they urgently sold this movable and immovable property.

Analysis of the family's legal income and savings indicates that the officials and their close relatives could not have acquired the mentioned assets through legal income.

The decision of the HACC Appeals Chamber enters into legal force from the moment of its pronouncement.

As a reminder, according to the Law of Ukraine "On Prevention of Corruption," a person authorised to perform the functions of the state or local self-government, against whom a court decision recognising assets as unsubstantiated and their recovery as state revenue has entered into legal force, is subject to dismissal from office in the manner prescribed by law.
