In April 2024, the National Agency on Corruption Prevention (NACP) monitored 392 draft legal acts: 274 draft acts of the Cabinet of Ministers of Ukraine (CMU) and 118 draft laws. Based on the results of the monitoring, corruption-prone factors were identified in five draft regulations and anti-corruption examinations were conducted. These documents identified 10 corruption-prone factors and provided 14 recommendations for their elimination.
In particular, this refers to the draft Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on the Sale and Export of Timber and Certain Wood Products”. In it, the NACP identified provisions that create conditions for corruption:
- inconsistency with the provisions of the Law of Ukraine “On the Permitting System in the Field of Economic Activity”
- establishment of a non-transparent mechanism for exercising the powers of officials of the State Forest Resources Agency of Ukraine when deciding on the revocation of certificates of origin of timber and certain wood products;
- the risk of unreasonable decision-making on refusal to issue a certificate of origin of timber and certain wood products.
The National Agency provided the State Forest Resources Agency, which is the developer of the draft act, with recommendations for establishing a transparent procedure for issuing certificates of origin for timber and certain wood products.
The NACP also conducted an anti-corruption expertise of the draft resolution of the Cabinet of Ministers of Ukraine “On Amendments to the Procedure and Conditions for Providing Subventions from the State Budget to Local Budgets for the Arrangement of Safe Conditions in General Secondary Education Institutions”. The NACP identified a number of corruption-prone factors in it:
- Establishing prejudicial mechanisms for regional state administrations (military administrations) to select objects for further inclusion in the list of projects for the improvement of safe conditions in general secondary education institutions;
- vesting the Ministry of Education and Science of Ukraine with discretionary powers to determine the criteria for the commission to compile a list of projects for the improvement of safe conditions in general secondary education institutions;
- establishing a non-transparent mechanism for the creation and operation of a commission to review proposals for the formation of a list of projects to improve safe conditions in general secondary education institutions.
The National Agency provided the Ministry of Education and Science of Ukraine, which is the developer of the project, with recommendations for establishing a transparent mechanism for providing subsidies from the state budget to local budgets for the improvement of safe conditions in general secondary education institutions.
