Assets worth UAH 7 million confiscated from law enforcement officers' spouses based on NACP lifestyle monitoring: decision of the HACC Appeals Chamber

On December 3, 2024, the Appeals Chamber of the High Anti-Corruption Court (HACC) upheld the decision of the first instance court of July 24, 2024, which declared unjustified assets totaling UAH 7 million acquired by the deputy head of one of the SBI departments and his wife, a prosecutor of the regional prosecutor's office.

The court recognized as unjustified assets an apartment in Kyiv acquired in early 2020 for almost UAH 3.8 million and registered in the name of the defendant's grandmother, and a parking space purchased in the same period for UAH 0.7 million and registered in the name of the defendant's aunt.

The court also recognized an apartment in Kyiv, registered in the name of the defendant's aunt, worth almost UAH 2.8 million at the time of purchase in 2022, as a partially unjustified asset. The court decided to recover from the defendants a part of the value of the partially unjustified asset in the amount of over UAH 2.5 million in favor of the state.

The claim was filed on the basis of the materials of the National Agency on Corruption Prevention (NACP) and evidence obtained by the prosecutor of the Specialized Anti-Corruption Prosecutor's Office (SAP) in accordance with the procedure established by law.

The decision of the HACC Appeals Chamber comes into force upon its announcement.

As a reminder, in July 2024, the High Anti-Corruption Court recognized a number of assets acquired by third parties on behalf of and in the interests of the former deputy head of one of the SBI's territorial departments and his wife, a prosecutor of the regional prosecutor's office, as unjustified and ordered their recovery for the state. The decision was made following the SAPO's lawsuit and is based on the materials of the lifestyle monitoring conducted by the NACP. According to the results of the lifestyle monitoring, it was established that the officials' standard of living did not correspond to their declared property and income.

The couple subsequently appealed the HACC decision to the HACC Appeals Chamber.
