On December 11, 2024, the High Anti-Corruption Court (HACC) upheld the claim of the prosecutor of the Specialized Anti-Corruption Prosecutor's Office to declare as unjustified the assets worth UAH 5.6 million identified as a result of a full inspection of the National Agency on Corruption Prevention (NACP) in the declaration of the Head of the Main Department of the State Migration Service of Ukraine in Odesa region.
NACP found that in 2023, the official's mother purchased a Mercedes Benz G400 D worth more than UAH 5.6 million. At the same time, the woman had no legal sources of income for such a purchase and did not have the right to drive the car. In fact, the said car was used by the official and his close relatives, i.e., it was he who could perform actions with this asset identical to the right to dispose of it.
After reviewing the NACP's substantiated conclusion regarding the signs of false information in the declaration, the State Bureau of Investigation initiated criminal proceedings under Part 1 of Article 366-2 of the Criminal Code of Ukraine.
Taking into account the established facts, the prosecutor filed a lawsuit to confiscate the asset to the state due to doubts about its legal origin.
The HACC upheld the prosecutor's position, recognized the assets as unjustified, and ruled to confiscate them to the state.
The court's decision has not yet entered into force and may be appealed within 30 days from the date of its full text.
