The High Anti-Corruption Court (HACC) upheld the claim of the Specialised Anti-Corruption Prosecutor's Office (SAPO) and recognised as unjustified assets worth over UAH 5 million belonging to the son and close relatives of a deputy of the Velyka Dymerka settlement council in the Brovarsky District of the Kyiv Region.
The basis for this court decision was the results of monitoring the lifestyle of the elected official, which was carried out by the National Agency on Corruption Prevention (NACP) based on criminal proceedings materials sent by the Brovarsky District Prosecutor's Office on the fact of committing a serious crime in the field of environmental protection.
During the monitoring of the lifestyle, the NACP authorised person found out that the former wife of the official owns a 2023 Volkswagen ID 4 worth over UAH 1 million, and his adult son owns a 2015 Jaguar XF. However, the vehicles were actually purchased on behalf of the deputy, who used them. In addition, the official's mother-in-law, ex-wife and son became owners of ten land plots.
After analysing the income and savings of the deputy, his ex-wife, son and mother-in-law, the NACP established that they could not have acquired the specified movable and immovable property from their legal income.
It is also worth noting that during the monitoring of the declarant's lifestyle, his mother-in-law alienated a number of land plots in favour of close relatives. However, thanks to timely procedural measures taken by the SAPO, the HACC imposed an arrest on the property to prevent its further alienation.
The court found that the Volkswagen ID 4 and Jaguar XF cars, as well as the land plots belonging to the people's representatives' relatives, were unjustified.
The court's decision may be appealed within 30 days of the date it is entered.
In accordance with the Law of Ukraine ‘On Prevention of Corruption,’ a person authorised to perform functions of the state or local self-government, in respect of whom a court decision on the recognition of assets as unjustified and their confiscation in favour of the state has entered into legal force, is subject to dismissal from office in accordance with the procedure established by law.
