In July 2024, the National Agency on Corruption Prevention (NACP) issued a number of protocols on administrative offenses related to ethical behavior and prevention and settlement of conflicts of interest. The courts also made several decisions based on the NACP materials.
For example, an administrative offense report was filed against a judge of the Lokhvytsia District Court of Poltava Oblast who, acting in a real conflict of interest, considered a civil case brought by her mother. The judge's actions were qualified under Part 2 of Art. 172-7 of the Code of Ukraine on Administrative Offenses (CUAO).Code of Ukraine on Administrative Offenses
A report was drawn up against the head of the Documentation Department of the National Police of Ukraine for committing a similar administrative offense. He failed to report a conflict of interest and, acting in conditions of a real conflict of interest, initiated material incentives for a subordinate with whom he had family ties and to whose family he owed a debt under a loan agreement in 2022-2023.
Also, for committing an administrative offense under Part 1 of Art. 172-4 of the Code of Administrative Offenses (violation of restrictions on combining work and other activities), reports were drawn up against:
- head of the Department of Education, Culture, Sports and Healthcare of Skadovsk District State Administration (along with her position, she worked part-time in an international foundation);
- an officer of the Pryluky District Police Department of the Main Directorate of the National Police in Chernihiv Oblast (he was engaged in entrepreneurial activity as a member of a farm).
Based on a report drawn up by the NACP, the Prymorskyi District Court of Odesa found the Deputy Head of the Inspection Department of the Shipping Administration guilty of committing an administrative offense related to corruption (Article 172-4 of the Code of Administrative Offenses). For six months, he also held the position of director of a private enterprise, which violated the restrictions on combining and holding two jobs.
For committing a similar offense, the Halytskyi District Court of Lviv imposed an administrative penalty on the head of a department of the Lviv Regional State Administration. The official held the position of director of two LLCs at different times.
