NACP approved the procedure for monitoring compliance with lobbying legislation

The National Agency on Corruption Prevention (NACP) has approved the Procedure for Monitoring Compliance with Lobbying Legislation (hereinafter – the Procedure), which regulates the monitoring process, contributing to legal certainty, optimization, accountability, and transparency of the results of such a procedure.

The corresponding NACP order dated 3 October 2025, No. 303/25, registered with the Ministry of Justice of Ukraine on 17 October 2025 under No. 1505/44911, entered into force on 12 November 2025.

This document defines the procedure for conducting monitoring, the rules for its initiation and completion, the timelines for monitoring, the sources of information on the basis of which monitoring is carried out, as well as the decisions that may be made within and as a result of monitoring.

The Procedure also regulates the review and requirements for reports on violations of lobbying legislation. Such a report must include the identifying information of the complainant and the lobbying entity or the person who has not acquired the status of a lobbying entity, factual information regarding possible signs of legislative violations that may be subject to monitoring and verified by the NACP, as well as the date and signature of the complainant.

! Reports submitted without compliance with the above requirements are returned to the complainant with corresponding explanations within 5 days from the date of receipt by the NACP.

The aforementioned order was issued, in particular, to implement measures provided for in the Roadmap on the Rule of Law and the Roadmap on the Functioning of Democratic Institutions, approved to fulfill Ukraine’s commitments under the European Union negotiation framework.

In August 2025, the NACP conducted public consultations on the draft Procedure and also received an opinion from the Public Council under the NACP regarding it. The draft Procedure was also coordinated with the relevant authorities.

We remind that on 1 September 2025, the Law of Ukraine “On Lobbying” entered into force, establishing the legal framework for the development of a transparent and responsible lobbying culture, defining the rules for influencing the legislative process, and ensuring its accountability to society. Simultaneously with the entry into force of the Law, the NACP launched into full operation the key tool for its implementation – the Transparency Register, an open public platform that collects, processes, and discloses data on lobbying entities and their reporting.
