Transfer of Ministry of Defense of Ukraine developments to verified companies for serial production: government approves resolution taking into account all NACP recommendations

The Cabinet of Ministers of Ukraine has approved a resolution that launches an experimental mechanism for transferring technologies developed within the system of the Ministry of Defense of Ukraine into serial production. This decision opens state developments to the market and is expected to increase the production volume of verified equipment and expand the range of weapons.

Earlier, the National Agency on Corruption Prevention (NACP) conducted an anti-corruption examination of the draft resolution to timely identify possible corruption risks and eliminate them. As a result of the anti-corruption examination, specialists identified corruption-prone factors that could have led to abuses during the conclusion of Ministry of Defense contracts with manufacturers granting the right to use technologies.

According to the developed procedure for implementing such an experimental project, interested manufacturers could submit notifications to the Ministry of Defense expressing interest in obtaining the right to use Ministry of Defense technologies. However, the draft regulatory act did not regulate the content and mandatory requirements of such notifications. In addition, the criteria that manufacturers had to meet were unclear. The draft procedure also contained evaluative legal constructions, which created a risk of a subjective approach by Ministry of Defense officials when making decisions on concluding contracts with manufacturers.

In the conclusion of the anti-corruption examination, NACP provided recommendations to eliminate the identified corruption-prone factors. The Ministry of Defense revised the draft resolution jointly with NACP and took all recommendations into account.

From now on, manufacturers gain access and the ability to produce weapons and military equipment based on state technologies that have proven effective in combat conditions. Access is granted only to verified manufacturers according to clear criteria. The technologies remain state property and are used in accordance with the approved procedures of the Ministry of Defense. The produced equipment will be supplied to the Armed Forces through state procurement.

Additionally, within the framework of international cooperation, defense agencies of partner countries may gain access to the technologies provided that the produced goods are supplied to Ukraine as military-technical assistance.

As a reminder, in the third quarter of 2025, NACP monitored over 1,300 draft regulatory legal acts (RLAs). Forty-five of them underwent an anti-corruption examination, which identified 116 corruption-prone factors and provided 147 recommendations for their elimination. Most of these recommendations were taken into account by the developers. Among the RLAs subject to anti-corruption examination, a significant share comprised documents in the areas of defense, recovery, economy, and law enforcement. In particular, NACP provided recommendations that regulated the procedure for conducting remote military medical commissions and minimized the risks of corruption-related abuses.
