On October 10, 2023, President of Ukraine Volodymyr Zelenskyy signed Law of Ukraine No. 3384-IX, "On Amendments to Certain Laws of Ukraine on Determining the Procedure for Submitting Declarations of Persons Authorized to Perform State or Local Government Functions under Martial Law" (the "Law"). The Law will enter into force on the day following its publication.
"The National Agency on Corruption Prevention welcomes the restoration of the obligation to submit declarations, notifications of significant changes in property status, and the authority to conduct full and special (when appointed to managerial and other important positions) verifications of declarations and will provide open round-the-clock access to the Unified State Register of Declarations no later than 60 days after the Law enters into force after ensuring the safety of Ukraine's defenders," said NACP Head Oleksandr Novikov.
Within a month from the date of entry into force of the Law, the NACP must ensure that its regulations are brought in line with the new norms, including in terms of selecting declarations for full verification and the procedure for conducting such verifications.
The declaration campaign for 2021-2022 will last until January 31, 2024. By this date, declarants must submit declarations for the relevant reporting periods in 2021-2022, including for special audits, except for those who submitted them voluntarily earlier.
In addition, those who have already filed tax returns for 2021-2022 during martial law before the Law comes into force have the right to submit corrected tax returns for these periods. To do this, within 14 days from the date of entry into force of the Law, they will need to apply in writing to the NACP in any form to provide an opportunity to submit an amended declaration. After that, these declarants will be able to submit corrected declarations for these periods once within 30 calendar days (from the date of access opening). Declarants will be notified of this opportunity in their personal electronic accounts in the Register of Declarations without sending an official letter.
With the resumption of the declaration, financial control mechanisms are also launched. The submitted declarations will undergo logical and arithmetic control to determine the risk rating. The declarations with the highest risk rating will be selected for a full review, which will allow us to verify the legality of the acquisition of assets by those officials who have not been in line for years.
