The Civil Cassation Court within the Supreme Court has confirmed the legality of decisions by the High Anti-Corruption Court (HACC) and the Appeals Chamber of the HACC recognising assets worth over UAH 8.6 million registered in the name of the mother of a Kyiv Customs official as unjustified.
The assets in question are a residential house and six land plots in the suburbs of Kyiv, which were acquired in 2023 by the mother of the Head of the "Fastiv" Customs Clearance Sector at the "Pivdennyi" Customs Post of Kyiv Customs.
Based on the results of lifestyle monitoring of the official, the National Agency on Corruption Prevention (NACP) established circumstances indicating the absence of legal income sources for his mother to acquire this property. Sufficient legal income and savings to acquire these assets were also lacking for both the official himself, who has been in public service for over 25 years, and his wife, who previously worked for customs authorities.
That the real estate could have been acquired in the official's interests was also indicated by the fact that the mother granted powers of attorney to her son and his wife to represent her interests regarding these objects, while they were the ones who actually used the property.
Based on NACP materials and evidence gathered independently by a prosecutor of the Specialized Anti-Corruption Prosecution Office (SAPO), the courts recognised the assets as unjustified and ordered their forfeiture to the state revenue.
The Supreme Court upheld these decisions. The ruling is final and not subject to appeal.
