AP HACC confirms confiscation of assets registered to mother-in-law of Kyiv deputy police chief

The Appeals Chamber of the High Anti-Corruption Court (AP HACC) has ruled that assets used by the Deputy Chief of the Main Directorate of the National Police in Kyiv and his family are unsubstantiated.

The court of appeal partially amended the HACC’s initial decision regarding the determined value of the apartment subject to recovery; in all other respects, the ruling remained unchanged.

According to the AP HACC decision, the following will be recovered as state revenue through civil forfeiture (Art. 290 of the Civil Code of Ukraine):

  • 2 parking spaces;
  • The value of the apartment (over UAH 3.3 million);
  • Income received from its sale (nearly UAH 5 million).

As a reminder, during a lifestyle monitoring of the official, the National Agency on Corruption Prevention (NACP) established that the aforementioned assets were purchased by the law enforcement officer’s mother-in-law in 2020 at his direction. However, the official and his family subsequently used them.

After analysing the income and expenses of the police officer's family and his relatives, the Agency concluded that it was impossible to acquire said property through legal income.

It is worth noting that the NACP initiated the lifestyle monitoring of the official in 2024 based on its own findings. Subsequently, he came under the scrutiny of journalists from the “Schemes: Corruption in Details” program. After the media report aired, the “owner” sold the apartment for UAH 5 million more than its original purchase price.

The grounds for the court application were the materials from the NACP lifestyle monitoring, as well as evidence independently gathered by the SAPO prosecutor, including materials from the journalistic investigation.

The decision of the AP HACC takes legal effect from the moment of its pronouncement.

Reference: According to Paragraph 10, Part 1, Article 77 of the Law of Ukraine “On the National Police,” a police officer is subject to dismissal if a court decision recognising their assets (or assets acquired on their behalf by others) as unsubstantiated and ordering their recovery to the state enters into legal force.
