The High Anti-Corruption Court (HACC) has partially satisfied a lawsuit filed by a prosecutor of the Specialized Anti-Corruption Prosecutor's Office (SAPO) to recognize the assets of the former head of the department for combating organized groups with signs of corruption of the strategic investigations directorate in the city of Kyiv of the Department of Strategic Investigations of the National Police of Ukraine as unjustified, and to forfeit them to state revenue.
The lawsuit was filed based on materials from the National Agency on Corruption Prevention (NACP), the State Bureau of Investigation, and evidence independently gathered by the SAPO prosecutor.
During a lifestyle monitoring of the official, the NACP established that between 2021 and 2023, he purchased and registered ownership of several expensive cars for himself and his family members, including:
- a 2022 VOLKSWAGEN TOUAREG, worth over UAH 2.9 million;
- a 2021 VOLKSWAGEN PASSAT, worth UAH 1.35 million;
- a 2022 BMW 330I, worth UAH 1.75 million.
In addition, in 2021, the police officer spent over UAH 500 thousand to form a cash asset of USD 27 thousand without having the financial capacity to do so. In 2023, more than UAH 700 thousand of undetermined origin was deposited into the accounts of the declarant and his wife.
The official explained that he received the funds to acquire the said property as loans and gifts from close relatives. At the same time, an analysis of the income and expenditures of the declarant and his family members showed a lack of sufficient legal income for such assets.
It was also established that one of the cars was registered to a relative of the former police officer who worked as a security guard in one of the grocery and industrial supermarket chains in Ukraine. However, the examined evidence, including bank documents, information on the use, storage, and maintenance of the car, confirmed the actual possession and use of this asset by the declarant himself.
Based on the results of the case review, the HACC recognised assets worth over UAH 6.7 million as unjustified and ordered their forfeiture to state revenue:
- a portion of cash savings amounting to over UAH 540 thousand;
- a 2021 VOLKSWAGEN PASSAT car worth over UAH 1.3 million (recovery of value);
- income received from the sale of this car for UAH 150 thousand;
- a 2022 VOLKSWAGEN TOUAREG car worth over UAH 2.9 million (recovery of value);
- a 2022 BMW 330I car worth over UAH 1.7 million.
The court's decision may be appealed within 30 days from the date its full text is drawn up.
As a reminder, the HACC recently recognised nearly UAH 3 million in assets of the former head of the Kremenchuk Territorial Center for Recruitment and Social Support (TCC) as unjustified.
