Apartment in mother-in-law’s name: assets worth UAH 3.7 million may be confiscated from Head of an MIA service center in Kharkiv region

A prosecutor of the Specialized Anti-Corruption Prosecutor’s Office (SAPO) has filed a lawsuit with the High Anti-Corruption Court (HACC) seeking to declare the assets of the head of one of the service centres of the Ministry of Internal Affairs (MIA) in Kharkiv region unjustified, in the amount of over UAH 3.7 million, and to recover them in favour of the state.

The grounds for filing the lawsuit were materials from the National Agency on Corruption Prevention (NACP) and evidence collected by the State Bureau of Investigation (SBI).

The Agency initiated monitoring of the official’s lifestyle following a review of a corruption report submitted by the SBI's territorial department in Poltava.

In particular, the NACP established that the head of the service centre had acquired assets whose value significantly exceeded his confirmed lawful income. These include, in particular, an apartment in Kharkiv worth over UAH 3.9 million, registered in the name of the official’s mother-in-law.

The established difference between the value of this asset and the lawful income of the declarant exceeds UAH 3.7 million.

In this regard, the SAPO prosecutor filed a lawsuit with the HACC seeking to declare the asset unjustified and to recover it in favour of the state.

Note. According to the law, the grounds for filing a claim to declare assets unjustified are the excess of their value over lawful income by more than UAH 1,505,250.

Reminder. Recently, the HACC Appeals Chamber upheld the decision of the court of first instance on the civil confiscation of assets worth over UAH 5.3 million used by the family of a former head of the Main Directorate of the State Tax Service in Odesa region.
