NACP formulates recommendations for eliminating corruption risks in the mandatory technical control system for vehicles

The National Agency on Corruption Prevention (NACP) has published a comprehensive study entitled "Corruption risks in the sphere of mandatory technical control of vehicles" and formulated recommendations regarding anti-corruption safeguards for reforming the mandatory technical control (MTC) system for vehicles.

The Agency conducted this study jointly with the Ministry for Restoration, Infrastructure and Transport of Ukraine (Ministry for Development) with the support of the non-governmental organization "Together Against Corruption".

The National Program for the Adaptation of Ukrainian Legislation to the EU acquis identifies the absence of mandatory technical inspection for private passenger cars as one of the key problems. Given the complexity of the MTC sphere and the need to further align Ukrainian legislation with EU law, the Ministry for Development turned to the NACP with an initiative to conduct a strategic analysis of corruption risks in the MTC sphere to ensure the preparation of a transparent and effective legislative framework for the MTC system reform.

As part of the study, the NACP identified 9 corruption risks covering all stages of the MTC system: from market access and conducting inspections to recording and transmitting results, monitoring, oversight, and liability enforcement. In particular, these include the fragmented nature of the market access procedure, the lack of a clear and transparent document verification procedure for obtaining MTC subject status, the absence of a clearly defined legal status for the person conducting the inspection, insufficient automation of the transmission of measured parameters which enables falsification of results, as well as the lack of an integrated oversight system and the disproportionate nature of liability in the MTC sphere.

Data from the Main Service Centre of the Ministry of Internal Affairs confirms the scale of the problem: between 2023 and 2025, 3,929 conclusions declaring vehicle technical condition inspection protocols invalid were issued, and 325 subjects were excluded from the register of MTC subjects.

Previous experience with the functioning of the technical inspection system demonstrated that without proper safeguards, the reform risks recreating the same corruption practices in a new form, but on a significantly larger scale.

Based on the results of the study, recommendations were formulated for the Ministry for Development, the Ministry of Internal Affairs, and the National Accreditation Agency of Ukraine aimed, in particular, at introducing a single transparent market access mechanism, digitizing and automating MTC processes, regulating the legal status of the person directly conducting the inspection, establishing an integrated oversight system, and revising approaches to the liability of MTC subjects

Implementation of these recommendations is intended to ensure a transition from a formal MTC model to a system where every stage is predictable, transparent, and controlled, as well as to foster fair market competition, minimise fictitious inspections, and build public trust in technical control results.

In July 2026, the preliminary results of the study were presented at an event with representatives of the European Commission, the Ministry for Regional Development, the Main Service Centre of the MIA, SE "State Road Transport Research Institute", business, and the public.
