A prosecutor from the Specialized Anti-Corruption Prosecutor's Office (SAPO) has filed a lawsuit with the High Anti-Corruption Court (HACC) to recognise more than UAH 5.4 million in assets belonging to the former head of a department of the Main Directorate of the State Tax Service in the Lviv region as unjustified.
The grounds for the court filing were materials from a comprehensive audit of the 2023 declaration conducted by the National Agency on Corruption Prevention (NACP), the State Bureau of Investigation (SBI), as well as evidence independently obtained by the prosecutor.
The lawsuit concerns an unfinished construction project – a residential house with an area of 133.5 square meters, and a land plot in a cottage community near Lviv, acquired by the former official's family in 2023.
An analysis of income from confirmed sources and expenses incurred established that the value of the specified property exceeds the family's legal income by more than UAH 5.4 million.
In view of the identified signs of unjustified assets, the SAPO prosecutor petitioned the court for their recovery into state revenue.
Furthermore, during the audit, the NACP established that the former official concealed the aforementioned unfinished construction project, which has a market value of nearly UAH 7 million, and failed to confirm the legal origin of UAH 500,000 in declared cash. Regarding this fact, a prehistoric investigation by the SBI is ongoing in criminal proceedings under Article 366-2 of the Criminal Code of Ukraine (declaration of false information).
Note: Pursuant to part one of Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and shall not be subjected to criminal punishment until their guilt is proved through legal procedure and established by a court's verdict of guilty.
