On July 22, 2023, SBI officers served a notice of suspicion to Yevhen Borysov, former head of the Odesa Regional Territorial Center for Recruitment and Social Support of the Operational Command "South" of the Land Forces of the Armed Forces of Ukraine, for illicit enrichment and intentional evasion from service. The NACP handed over the materials that formed the basis of the suspicion to the State Bureau of Investigations (SBI) three days ago, on July 19, 2023. It is about the illegal enrichment of the official by more than UAH 188 million. Based on the results of the monitoring of the official's lifestyle, the National Agency sent a substantiated conclusion to the SBI on the commission of a crime under Art. 368-5 of the Criminal Code of Ukraine (illicit enrichment). In general, he is suspected of: - acquisition of assets whose value is more than 6,500 tax-free minimums higher than his legitimate income; - failure to report for service on time without valid reasons under martial law; - evasion from military service by deception committed under martial law. The sanctions in the articles provide for imprisonment for up to 10 years. As a reminder, Borysov became famous after a journalistic investigation revealed that his mother had become the owner of a residential building in Spain worth EUR 3.7 million last year. The NACP found that she could not have purchased this expensive property (UAH 154 million at the NBU exchange rate at the time of purchase) at her own expense, as her total income over the past 20 years amounted to just over UAH 4 million. Borysov explained to the NACP that, at the time of the purchase of the house in question, his mother had $4.2 million. The money was allegedly borrowed from different people. As evidence, he provided copies of the agreements. However, during the monitoring of the official's lifestyle, it turned out that, in addition to luxury real estate in Spain, Borysov's mother also purchased a 2022 Mercedes-Benz EQV worth almost UAH 3 million this year. Borysov explained that the purchase was also made with borrowed funds and on the basis of the same agreements. However, after reviewing them, reasonable doubts arose as to the authenticity of the borrowers' personal signatures. It later turned out that some of them could not physically be present when the documents were signed. In addition, it was found that one of the borrowers did not have sufficient monetary assets and therefore could not lend the amount indicated in the documents to Borisov's close associates. All of this points to signs of a legal fiction, as none of the borrowers could have been the source of the funds for which the mansion in Spain and the car were allegedly purchased. During the monitoring of the official's lifestyle, it was also found that the ex-military commander's mother-in-law had purchased several cars in recent years without having sufficient monetary assets that could have come from legal sources. Namely: - Toyota Land Cruiser Prado made in 2021 (the indicated cost is UAH 480 thousand with the real price of USD 58.5 thousand). This may indicate concealment of the real value; - Mercedes-Benz G 63 AMG 2022, worth almost UAH 8.5 million; - Toyota Land Cruiser 2023, worth UAH 3 million At the same time, during the monitoring of the official's lifestyle, his mother and mother-in-law did not have driver's licenses at all. Earlier this year, Borysov's wife also purchased foreign real estate - an office space in Spain worth 510 thousand euros, also without having sufficient monetary assets or income from legal sources.
