The National Agency on Corruption Prevention (NACP) has sent a report on administrative offenses against former Deputy Head of the Presidential Office of Ukraine Kyrylo Tymoshenko to the Pecherskyi District Court of Kyiv.
However, Mr. Tymoshenko did not appear despite an official invitation and a promise to come to the National Agency to receive the protocol appointed on July 28. The former official also did not respond to the letter addressed by NACP to review, sign, and provide explanations and comments on the content of the protocol.
As a reminder, during the NACP's inspection, it was found that the official enjoyed his powers in his personal interests and violated the restrictions on receiving gifts by a person holding a particularly responsible position, as set out in the Law on Prevention of Corruption.
Therefore, while holding the position of Deputy Head of the Prosecutor General's Office, he signed a letter to the State Border Guard Service of Ukraine (SBGS) requesting permission for his subordinate to travel abroad, allegedly for an official business trip. However, the NACP found that the real purpose of the subordinate's travel abroad was a private interest, namely obtaining visas for Mr. Tymoshenko and his son.
The former official enjoyed his official position and, with the aim of satisfying his personal needs, received permission for his subordinates to cross the state border. Such actions are classified under Parts 1 and 2 of Art. 172-7 of the Code of Administrative Offenses (Violation of the requirements for the prevention and settlement of conflicts of interest).
In addition, during 2022, Mr. Tymoshenko stayed three times at the Emili Resort hotel complex free of charge, twice with his wife and son. According to his explanations, Mr. Tymoshenko confirmed that he had indeed used the services of the hotel but could not provide proof of payment for accommodation worth more than UAH 45,000.
Another episode of his actions was related to the existing conflict of interest.
In the summer of 2022, Mr. Tymoshenko used a Porsche Taycan for personal use, free of charge. It has been identified that certain facts indicate the artificial nature of payment documents that were aimed at concealing the fact of unpaid use of the vehicle. The total amount of the unpaid car rental services received by Mr.Tymoshenko amounted to UAH 122,000.
The total value of the services received by Mr. Tymoshenko as a gift amounted to over UAH 167,000. His actions are classified under Part 1 of Art. 172-5 of the Code of Administrative Offenses (Violation of statutory restrictions on receiving gifts).
The NACP sent a copy of the protocol along with the case file to the Pecherskyi District Court of Kyiv for consideration.
The stated violations are punishable by a fine as well as possible inclusion in the Register of Corrupt Officials.
