Over UAH 5 million in unjustified assets to be confiscated from the family of the Kyiv region councillor

The Appeals Chamber of the High Anti-Corruption Court (AC HACC) has upheld the lower court's decision to recognise as unjustified and recover into state revenue assets worth over UAH 5 million belonging to close associates of a councillor of the Velyka Dymerka Village Council, Brovary District, Kyiv Region.

The court confirmed the legality of recovering the following assets into state revenue:

  • A Volkswagen ID.4 (2023 model) valued at over UAH 1 million, registered in the name of the official’s former wife;
  • A Jaguar XF (2015 model) owned by his son;
  • 10 land plots owned by the councillor's mother-in-law, former wife, and son.

As previously reported, the grounds for the lawsuit filed by a prosecutor from the Specialized Anti-Corruption Prosecutor's Office (SAPO) were the results of lifestyle monitoring conducted by the National Agency on Corruption Prevention (NACP), based on materials from criminal proceedings provided by the Brovary District Prosecutor's Office.

After analysing the income and savings of the councillor, his former wife, son, and mother-in-law, the NACP established that they could not have acquired the specified movable and immovable property through legal income. At the same time, it was determined that despite the formal registration of the property in the names of relatives, the official himself exercised actual control and disposal of the assets.

Furthermore, attempts to alienate part of the assets were recorded during the lifestyle monitoring process. Specifically, the declarant's mother-in-law alienated a number of land plots in favour of other close associates. Thanks to timely procedural measures by SAPO, the relevant property was seized, preventing further alienation.

The decision of the AC HACC regarding the civil confiscation of the councillor's family's unjustified assets entered into legal force upon its pronouncement.
