NACP results in February: 301 legal acts were monitored, corruption risks were identified in five of them

In February 2024, the National Agency on Corruption Prevention (NACP) monitored 301 draft regulatory legal acts: 250 draft acts of the Cabinet of Ministers of Ukraine (CMU) and 51 draft laws. 

The monitoring revealed corruption-prone factors in five draft regulations. Accordingly, five anti-corruption examinations were conducted, during which 12 corruption-prone factors were identified and 20 recommendations for their elimination were provided.

Based on the results of the examination of the draft resolution of the Cabinet of Ministers "Some issues of appointment and payment of one-time financial assistance in case of death, disability or partial disability without establishing disability of persons holding the rank of private or commander of the civil protection service", the NACP identified provisions that create conditions for corruption:

- uncertainty of the subject of decision-making on the appointment of a one-time financial assistance in case of death, disability or partial disability without establishing disability of persons holding the rank of private or commander of the civil protection service and restriction of the right to appeal against such decisions;

- uncertainty of time limits for making decisions on the appointment and payment of one-time financial assistance;

- lack of clear conditions for making a decision on the existence of grounds for the payment of one-time financial assistance.

The NACP provided recommendations to the Ministry of Internal Affairs of Ukraine, which is the drafting agency, to establish a transparent mechanism for the appointment and payment of one-time financial assistance.  

Based on the results of the examination of the Draft Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Certain Issues of Military Service, Mobilization and Military Registration", Reg. No. 10449 dated 30.01.2024, the NACP identified a number of corruption-prone factors, including 

- selective prosecution of citizens who have not fulfilled their obligation to register in the electronic office of a conscript, person liable for military service, or reservist;

- complication of the legal mechanism of judicial protection of citizens' rights;

- vesting district (city) commissions for assignment to basic military service with discretionary powers to submit petitions for granting citizens of Ukraine deferrals from assignment to basic military service in cases not provided for by the legislation of Ukraine.

The NACP has submitted recommendations to the Verkhovna Rada Committee on National Security, Defense and Intelligence and the Verkhovna Rada Committee on Anti-Corruption Policy for consideration to address the above corruption risks.
