After the full-scale invasion of Russia, the National Agency on Corruption Prevention (NACP) conducted a strategic analysis of corruption risks in areas closely related to the war: providing housing for military personnel, crossing the state border, limiting the import of medicine and receiving humanitarian aid.
In addition, the NACP closely follows the reforms of urban planning and certification of seafarers.
"Over the past year, we have conducted in-depth analytical work to identify corruption risks in the most sensitive issues: border crossing by conscripts, restrictions on the import of medicines, urban planning reform. Our main goal is not just to complete the analysis with a good report, but with the help of a well-thought-out sequence of specific next actions and practical tools to influence the quality of state policy in various spheres for the integrity and minimizing opportunities for corruption", — said Andrii Vishnevskyi, Deputy Head of the NACP.What are the results of work by direction?
- Together with the "Patients of Ukraine" charitable foundation, we presented an analytical research "Corruption risks during restrictions on the circulation of medicinal products under martial law". Proposals for changes to the Procedure for Termination of the Registration Certificate of Medicines and to the Law of Ukraine "On Medicinal Products" have been developed. Thanks to this research, the NACP managed to stop the activity of the Commission of the Ministry of Health of Ukraine on the restriction of the import of medicines of Western manufacturers. Currently, the Ministry of Health (MOH) should make changes to the order taking into account the recommendations of the NACP to eliminate corruption risks. The position of the NACP on this issue is consistent with the position of the Antimonopoly Committee, the Business Ombudsman and the European Business Association.
- In cooperation with the Ministry of Digital Transformation, the Ministry of Development of Communities, Territories and Infrastructure of Ukraine, the Ministry of Health has finalized a number of draft resolutions of the Cabinet of Ministers of Ukraine, which provide for the establishment of the procedure for the distribution of funds from the United24 platform in the areas of humanitarian and medical aid, as well as the reconstruction of Ukraine.
- Prepared the research "Corruption risks in the field of training and certification of seafarers" with specific recommendations to prevent corruption. Based on the research, a joint action plan was developed with the Ministry of Community Development, Territories and Infrastructure of Ukraine to eliminate these risks. At the end of 2022, the Cabinet of Ministers of Ukraine adopted the updated Regulation on training and certification of seafarers. A state electronic system is being developed to prevent fraudulent actions and falsification of test results for obtaining permits for seafarers.
- Together with the analytical center StateWatch, the problem highlighted by the Anti-corruption Strategy until 2025 was investigated: providing housing for servicemen of the Armed Forces. The study provides a road map for minimizing these corruption risks.
- The results of the analysis of corruption schemes and risks during departure from Ukraine under martial law were presented. On the basis of the recommendations of the NACP and on the instructions of the Cabinet of Ministers of Ukraine, an interdepartmental action plan for the elimination of identified risks is being developed, which should soon be approved by the Cabinet of Ministers and implemented.
- Conducted a research of the mechanisms for the provision of humanitarian aid by the state in the conditions of martial law, where 19 corruption and other risks were identified. In particular, this concerns the impossibility of receiving compensation twice, ensuring an objective assessment of the value of destroyed property, and conflict of interests in the activities of reconstruction commissions. Recommendations for their elimination were prepared (with the support of EUACI) and submitted for use in the work to the relevant temporary investigative commission of the Verkhovna Rada of Ukraine.
- Corruption risks in higher education were analyzed (with the support of the United States Agency for International Development (USAID) together with the Association of Legal Clinics of Ukraine.
- The most common corruption risks in the management of utility companies were identified and recommendations aimed at eliminating and preventing the emergence of corruption schemes were developed.
- A comprehensive analysis of the medical and social examination procedure for establishing disability was conducted. Formed recommendations on the use of digital solutions to eliminate the most common corruption risks. The recommendations were included in the DAP project until 2025.
