NACP identified 447 corruption-generating factors based on anti-corruption expertise results for 9 months of 2026

12.10.2026

Over the first nine months of 2026, the National Agency on Corruption Prevention (NACP) monitored 2,729 draft normative legal acts, including 193 draft laws, 2,536 draft acts of the Cabinet of Ministers of Ukraine, and other normative legal acts.

Based on the monitoring results, the Agency conducted 151 anti-corruption expertises, identifying 447 corruption-generating factors and providing 493 recommendations for their elimination. Notably, the drafters of the normative legal acts took into account 98.6% of the NACP recommendations.

The Agency's work focused on identifying and eliminating corruption-generating factors in draft normative legal acts at their drafting stage, which makes it possible to prevent corruption risks before such acts enter into force.

Social-humanitarian sphere and recovery

Over the nine months of 2026, the NACP monitored 1,363 draft normative legal acts and conducted 70 anti-corruption expertises in this sphere. Based on their results, specialists identified 230 corruption-generating factors and provided 256 recommendations for their elimination.

Among the examples of effective work are anti-corruption expertises of draft resolutions of the Cabinet of Ministers of Ukraine, as a result of which the drafters fully took into account the NACP recommendations, and the corresponding decisions were adopted by the Government.

In particular, the NACP conducted an anti-corruption expertise of the draft Government resolution "On Reallocation of Certain State Budget Expenditures Provided to the Ministry of Education and Science for 2026, and Approval of the Procedure for Using Funds Provided in the State Budget in 2026 for Urgent Measures to Increase the Energy Resilience of Higher Education Institutions." The Agency's specialists established that certain provisions of the draft granted excessive discretionary powers to the commission responsible for allocating funds to implement urgent energy resilience measures in higher education institutions. At the same time, the procedure for considering and evaluating project applications lacked sufficiently transparent mechanisms, creating risks for the objective allocation of budget funds.

Based on the expertise results, the NACP provided recommendations to eliminate the identified corruption-generating factors. The Ministry of Education and Science of Ukraine fully took them into account, after which the Government adopted the relevant resolution.

Another example of effective cooperation was the anti-corruption expertise of the draft resolution of the Cabinet of Ministers of Ukraine "On Approval of the Procedure for Technical Inspection of Equipment for the Application of Plant Protection Products." The document was developed to adapt Ukrainian legislation to European Union law (EU acquis).

During the expertise, NACP specialists identified corruption-generating factors that created prerequisites for introducing a corruption-vulnerable procedure for the technical inspection of equipment for applying plant protection products used by professional users.

The NACP provided recommendations to eliminate the identified risks. The Ministry of Economy of Ukraine fully took them into account, after which the Government adopted the relevant resolution.

Economy and law enforcement sphere

In this sphere, over the nine months of 2026, the NACP monitored 1,090 draft normative legal acts and conducted 53 anti-corruption expertises. Based on their results, specialists identified 114 corruption-generating factors and provided 134 recommendations for their elimination.

In particular, the Agency conducted an anti-corruption expertise of the draft resolution of the Cabinet of Ministers of Ukraine "On Amendments to Resolution of the Cabinet of Ministers of Ukraine No. 950 of October 9, 2020." The draft resolution aimed to align the mechanism for engaging advisors to prepare public-private partnership and concession projects with the Laws of Ukraine "On Public-Private Partnership" and "On Concession."

The NACP provided recommendations to the Ministry of Economy to eliminate the opaque procedure for selecting advisors for providing services in the preparation of public-private partnership projects and projects implemented under concession terms by clarifying or excluding phrases that allow different approaches during advisor selection.

Currently, approval procedures with the drafter are ongoing to ensure that all NACP recommendations are taken into account in the final version of the draft act.

Security and defence sphere

In the security and defence sphere, as part of its monitoring over the nine months of 2026, the NACP analysed 276 draft normative legal acts and conducted 28 anti-corruption expertises. Based on their results, specialists identified 103 corruption-generating factors and provided 103 recommendations for their elimination.

In particular, the Agency monitored the draft resolution of the Cabinet of Ministers of Ukraine "Certain Issues of Development, Assimilation, and Production of New Types of Defense Goods Under Martial Law in Ukraine," developed by the Ministry of Defense of Ukraine. The draft resolution aimed to accelerate the development, assimilation, and production of new types of defence goods under martial law, as well as to update current state contracts according to the needs of the Armed Forces of Ukraine.

During the expertise, NACP specialists identified corruption-generating factors that created risks of introducing an opaque procedure for the development, assimilation, and production of new types of defence goods. Specifically, the draft resolution contained unclear procedures regarding the conclusion of state contracts, competitive selection, and consideration of participants' applications, and granted the customer excessive discretionary powers when establishing qualification requirements and making individual decisions.

In addition, the draft did not specify clear criteria for evaluating applications or the mandatory requirement to consider the commission's recommendations when determining winners. The absence of comprehensive requirements for publishing information on competitions also created risks of selective notification of potential participants and unequal access to concluding contracts.

Based on the results of the expertise, the NACP provided recommendations to eliminate the identified corruption-generating factors. Following approval procedures, the Ministry of Defense of Ukraine fully took into account the Agency's recommendations. This made it possible to clarify the legal regulation of the relevant procedures and minimise the risks of opaque development, assimilation, and production of new types of defence goods.
